TERMS AND CONDITIONS OF ATTENDANCE AND PARTICIPATION IN VIRTUAL EVENTS

‘We’, ‘us’ or ‘our’ means Rowan Yarns, a division of Sirdar Holdings Ltd., a company registered in England and Wales under company number 06367603. Our address and registered office is at Sirdar Spinning Ltd., Flanshaw Lane, Alverthorpe, Wakefield, West Yorkshire, WF2 9ND; and

‘You’ or ‘your’ means the person using our site to register for Virtual Events..

1. INTRODUCTION

1.1 If you register for virtual events on our site you agree to be legally bound by this contract. If you are registering on behalf of another individual, it is your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual you are confirming that you have made the Participant aware of these terms and that they have accepted these terms.

2. YOUR PRIVACY AND PERSONAL INFORMATION

2.1 Our Privacy Policy is available at https://www.knitrowan.com/privacy. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

3. Participant Requirements

3.1 Access. Your payment (if applicable) and registration entitles you to access the Virtual Event for which you have registered. Rowan shall have no liability for other costs associated with your attendance.

3.2 Use of Likeness. By switching on your camera during in the Virtual Event you acknowledge and agree to grant Rowan the right to record, film, live stream, photograph, or capture your likeness in any media and to use such media without any further approval from you or any payment to you. This grant to Rowan includes, but is not limited to the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or share the media.

3.3 Virtual Event Content. You acknowledge and agree that Rowan reserves the right to change any and all aspects of the Virtual Event, including but not limited to, the Virtual Event date, time, title, content, programme, speakers, designers and hosts. The Virtual Event content may be recorded by Rowan and may be accessible to registered Participants where appropriate.

4. Prohibited Conduct

4.1 Disruptive Behaviour. Rowan does not tolerate bullying, harassment or disruptive behaviour. You acknowledge and agree that Rowan reserves the right to remove you from the Virtual Event if Rowan determines that your behaviour hinders the enjoyment of the Virtual Event content by other attendees.

4.2 Limitations on Use. By registering for a Rowan Virtual Event you agree not share your access link unless permission is granted by Rowan. By registering for a paid Virtual Event, you agree not to share, sell or trade your access.

4.3 Videotaping, Recording, Live Streaming. Participants may not record or broadcast audio or video of sessions at Rowan Virtual Events.

5. Registration and Fees

5.1 Payment. The payment of any applicable fee and any taxes for the Virtual Event is due upon registration. 

6. Cancellation and Quality Assurance

6.1 Rowan endeavours to provide the best experience possible. As hosts, speakers and designers are often booked well in advance of the Virtual Event, some unforeseen changes may occur in the line up. Rowan will work to ensure comparable speakers and topics participate in the Virtual Event.

6.2 For paid Virtual Events, cancellations are subject to the entire Virtual Event fee. All sales are final. No payments will be refunded. Please note that if you do not access the Virtual Event, you are still responsible for payment. In no circumstances shall Rowan be obligated to refund all or a part of the registration fee.

6.3 If Rowan is prevented from providing the Virtual Event you registered for as a result of any cause beyond its control, or the Virtual Event cannot be conducted because of technical issues or due to Force Majeure, Rowan has the right to immediately terminate the affected Virtual Event without liability and shall be relieved of its obligations to you. Rowan will strive to reschedule the affected Virtual Event and your registration fee (if applicable) will be applied to the rescheduled Virtual Event.

7. Virtual Event Registration Confirmation

7.1 Once you have completed your registration for the Virtual Event, you will receive confirmation by email. Please ensure that a valid email is entered correctly on the registration form. You will receive essential information at the email address you provide on the registration form

5.2 If you would like to opt-out of any of these emails, a link is provided in each email to provide the ability to opt-out.

8. Intellectual Property

8.1 All intellectual property rights in the Virtual Event content and all materials distributed in connection with the Virtual Event are owned by Rowan or the event sponsors, designers or speakers at the Virtual Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks, trade names or other content appearing at the Virtual Event.

9. LIMIT ON OUR RESPONSIBILITY TO YOU

9.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for losses that were not foreseeable to you and us when the contract was formed; or that were not caused by any breach on our part; or business losses; or losses to non-consumers.

9.2 No one other than a party to this contract has any right to enforce any term of this contract.

10. DISPUTES

10.1 We will try to resolve any disputes with you quickly and efficiently.

10.2 If you are unhappy with our service to you; or any other matter please contact us as soon as possible using the contact form on our site.

10.3 If you and we cannot resolve a dispute using our internal complaint handling procedure, you may also use the online dispute resolution (ODR) platform to resolve the dispute with us. For more details, please visit the website on the Your Europe’ portal.

10.4 The laws of England and Wales will apply to this contract. In the event of a dispute, the English courts will have exclusive jurisdiction. As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions affects your rights as a consumer to rely on such mandatory provisions of your local law.

11. THIRD PARTY RIGHTS

No one other than a party to this contract has any right to enforce any term of this contract.
